Information and conditions concerning delivery of products ordered by email

We only accept delivery addresses sent by email!!!

I. Delivery information

Delivery information

We work with the GLS courier service! There is a weight limit for entry-level Lay-Z Spa inflatable hot tubs. If the box weighs less than 40 kg, we will probably deliver it using the GLS courier service (delivery time: 2-3 days, depending on stock availability). If the weight exceeds 40 kg, we can send the product to the address provided using another external courier company (delivery time: 4-7 days, depending on stock availability).

Products can also be requested in an OEM package. This means that only the outer factory packaging differs. We divide the large, bulky factory box into two separate parts, distributing the weight between the parcels. The number, quantity and packaging of the products inside the boxes remain original; you simply do not receive a factory box.

Our parcel delivery partners:

– GLS Courier Service (payment is possible both in cash and by bank card)

– MPL (Hungarian Post) is used for certain products; the Seller sends an email notification about the delivery date. Payment on receipt is possible in cash, and by card with GLS.

Courier delivery

Deliveries take place on working days between 8 and 17. In most cases, home delivery of orders is carried out by the GLS courier service.
If delivery is unsuccessful, the courier service will attempt delivery again within 3 working days.
Please provide a delivery address where you can receive the parcel during the day. Please also provide a valid telephone number that you normally answer or use, because the courier will call the number provided half an hour before delivering the product to confirm the precise delivery time.
Parcels arrive at their destination within 24 hours, or a maximum of 48 hours, after collection. Products that are not in stock when ordered are an exception. We will send you information about this by email.

There are no deliveries at weekends or on public holidays!

II. Important information about delivery

A little more important information!

We would like to draw your attention to the fact that our website does not operate as an online shop. An order for products takes effect when an Order is sent to our email address (info@badushow.hu), providing the information we need for dispatch and invoicing.
When an order is placed, we send a reply by email concerning dispatch!
Please also check your spam folder, as our emails sometimes arrive there!
The delivery time shown next to product names on the website is approximate information.
Before ordering a product, ask us whether it is in stock, in an external warehouse, or being procured.
If a product is in stock and we receive the order by 12:00, there is a chance that we can hand it over to the courier the same day; in this case, the parcel may be with you the next day!
The GLS courier only delivers parcels on working days! Weekend deliveries occur only on rare or exceptional occasions.
The delivery time for products in stock depends on the courier’s speed, but generally the ordered product reaches you within 2-3 days of ordering.
Products in external warehouses may require a longer lead time: 4-6 days.
The lead time for products being procured depends on the speed of the ship, aircraft or external courier company. Only a general estimate of 15-30 days can be given here; it may be shorter or longer. We cannot influence the speed of external couriers.

IMPORTANT: The courier’s task is to deliver the ordered product to the precise address provided, notify the Buyer of the exact parcel arrival time, hand over the product and collect the amount payable for the product.

At the delivery address, the courier is only required to deliver the product to the kerb. The courier is not required to carry it upstairs or carry it 10-20 metres; it is the Buyer’s responsibility to carry the goods upstairs or into the house, warehouse, etc.

 

III. Delivery conditions

1.1) If the Seller offers delivery of the goods, delivery takes place within the delivery area specified by the Seller, to the delivery address provided by the Buyer, unless otherwise agreed. The delivery address specified in the Seller’s order processing is authoritative for completing the transaction.

1.2) Goods delivered by the carrier (GLS) are delivered to the “kerb”, meaning the public pavement nearest the delivery address, unless the Seller’s delivery information on its website states otherwise and there is no different agreement.

1.3) If delivery of the goods fails for reasons for which the Buyer is responsible, the Buyer bears the additional costs incurred by the Seller. This does not apply to delivery costs if the Buyer actually exercises the right of withdrawal. If the Buyer exercises the right of withdrawal, the rules in the Seller’s withdrawal provisions apply to return costs.

1.4) If the Buyer acts as a legal entity (company), the risk of accidental loss and accidental deterioration of the goods sold passes to the Buyer as soon as the Seller hands the product over to the forwarding agent, carrier, or other person or organisation responsible for transporting the consignment. If the Buyer acts as a consumer, the risk of accidental loss and accidental deterioration of the goods sold passes only when the goods are handed over to the Buyer or a person authorised to receive them. By way of exception, the risk of accidental loss and accidental deterioration of the goods sold also passes to the Buyer as soon as the Seller hands the goods over to the carrier,

1.5) The Seller reserves the right to withdraw from the contract if it has received an incorrect or unsuitable delivery address from the Seller. This applies only if the failure to deliver is not the Seller’s responsibility and the Seller has concluded a cover transaction with the supplier with due care. The Seller makes every reasonable effort to procure the goods. If the goods are unavailable or only partly available, the Buyer is notified immediately, and the Seller either refunds the price or makes up the quantity for the Seller or the Buyer.

1.6) If the Seller offers collection of the goods, the Buyer may collect the ordered goods at the address specified by the Seller during the working hours specified by the Seller. In this case, no delivery or other costs are charged.

IV. The delivery charge includes the following

V. DELIVERY

DELIVERY TO AN ADDRESS

The postal item must be delivered to the address on the item, subject to exceptions provided by the applicable legislation or by a different agreement between the Parties. The address on the item is the address that the sender has entered accurately and completely on the item, its packaging or the accompanying parcel label in accordance with points 5 and 6. If the sender does not provide the address in accordance with points 5 or 6 (for example, if the floor or door number is missing), the sender is liable for all resulting damage and for any inability of the Service Provider to deliver the item for this reason.

5.1. Delivery to a natural person

On delivery, the delivery driver hands the carefully packed and legibly addressed parcel to the addressee or, where the conditions specified in this section are met, to another authorised recipient.
For personal delivery, the addressee must ensure that the address can be approached easily and safely. If the addressee does not fulfil this obligation, or if personal delivery would endanger the physical safety of the person making the delivery or the security of property, the Service Provider delivers the item at a delivery point instead of the place indicated in the address and informs the addressee accordingly. The driver may not be kept waiting for more than 10 minutes during delivery; if kept waiting, delivery may be interrupted.
The postal item must be delivered to the addressee or, unless excluded by the particular additional service or by the contract between the Principal (sender) and the Service Provider, to another authorised recipient. Other authorised recipients include:
• an occasional recipient,
• a substitute recipient,
• an authorised representative,
• an indirect delivery intermediary.
Parcels are therefore handed over, against signature, to the addressee or other authorised recipients aged 14 or over who may reasonably be presumed, in the circumstances, to be authorised to receive the parcels. These primarily include persons present at the address, an authorised representative, a relative of the addressee aged 14 or over within the meaning of the Civil Code (Ptk.), the owner of the property at the address or the addressee’s accommodation provider as a substitute recipient, and, if the conditions in point 13 are met, the immediate neighbour as an occasional recipient.
GLS Hungary does not undertake delivery of parcels to prisoners in correctional institutions.

5.1. Delivery to a legal entity or organisation

An item is also regarded as addressed to a legal entity or other organisation if the name of a natural person appears in the address alongside the organisation’s name or address.
A parcel arriving at an organisation’s address may be delivered by personal handover if the organisation ensures that a representative is available at the property it uses and which can be indicated as its address. The organisation’s representative must be considered authorised to receive postal items addressed to the organisation.
The following persons are considered such representatives even without authorisation:
a) the head of the organisation and, without authorisation, the agent for service, the court-appointed agent for service, the insolvency liquidator and the voluntary liquidator;
b) an employee or member employed by the organisation when delivery is made at the organisation’s business premises or other premises open to customers;
c) if the organisation operates a mailroom, the natural person employed there;
d) if the organisation operates a reception desk, the natural person employed there;
e) an employee of the organisation who is not a representative as described above and whom the Service Provider regards, as an occasional recipient, as authorised to receive postal items.

VI. General rules on delivery

Whenever the applicable legislation makes delivery subject to the addressee’s consent, GLS Hungary arranges to obtain that consent in writing or orally.

GLS Hungary is not required to take account of information written on the postal item other than the address details. It is therefore not required to check, and does not check, whether another natural person with the same name is present at the address who might claim the item.

Delivery is authenticated electronically by the signature of the addressee or other authorised recipient or, failing this, delivery is confirmed on a form issued by GLS Hungary and its partners. In addition to the signature, the driver asks for the recipient’s name and records it alongside the data stored in the handheld scanner, so the recipient’s name can be retrieved through telephone or electronic parcel information.

Until proven otherwise, an electronic document that also contains the image of the signature captured by a signature-recording device constitutes full proof that the authorised recipient received the item during delivery of the recorded postal letter.

GLS Hungary delivers to a person who cannot write, or who is prevented from writing, in the presence of an adult witness. The witness signs their own name on the delivery document.

When a confidential item is delivered using AddresseeOnlyService, the recipient is the person designated by the sender, who must prove their identity using the documents specified by law. In this case, in addition to the recipient’s signature, the identification number of the photographic identity document presented by the recipient (for example, an identity card or passport) is also recorded.

Delivery takes place only after any amount due on delivery has been paid and the receipt has been signed (including electronically on a handheld barcode scanner). The addressee may not inspect the contents of the parcel before this.

VII. PARCEL WEIGHT AND SIZE LIMITS

Weight and size limits for domestic parcel delivery

Domestic delivery or a domestic parcel means a parcel dispatched and delivered within the country.
Domestic parcels may be dispatched up to a maximum weight of 40 kg per parcel. The girth (girth = 2X height + 2x width + 1x length) may not exceed 2 m. Accordingly, the maximum permitted parcel length is 2 m, the maximum height is 0,6 m and the maximum width is 0,8 m. The minimum parcel size is 15X10 cm and the minimum girth is 35 cm. The above figures must include the dimensions of the packaging!

GLS Hungary is entitled to refuse delivery of overweight parcels (meaning parcels exceeding 40 kg for domestic delivery) or parcels exceeding the size limits.

Weight limits for export and import consignments

Export and import parcels may be dispatched up to a maximum weight of 31,5 kg per parcel. The size limits for export and import consignments are the same as those applicable to domestic parcels.

VIII. DAMAGED PARCEL

Procedure when receiving a damaged parcel

When receiving the goods, please check the parcel for signs of damage and immediately make a complaint or ask the driver of the delivery company engaged by us to draw up a report. Please inform Badushow Hungary Bt of any damage noticed during transport. Damage observed on the parcel does not affect your statutory rights concerning defective performance and guarantees, but by paying attention and providing appropriate information, you can help with a complaint to the parcel sender and/or carrier.
